Welcome to Swansim.net (the “Website”), a digital platform operated by KEYWEALTH PARTNERS LTD (Company No. 15527653), registered in England & Wales and having its registered office at 167-169 Great Portland Street, 5th Floor, London, England, W1W 5PF (“Company”, “we”, “us” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of our Website, including the purchase and use of eSIM services (collectively, the “Services”).
By accessing the Website, creating an account, or completing a purchase or
activation of an eSIM, you (“User”, “you”) confirm your acceptance of these Terms. If you do not agree, please discontinue use of the Services immediately.
These Terms are subject to the laws of England and Wales, including (as applicable) the Consumer Rights Act 2015, Consumer Contracts Regulations 2013, the UK General Data Protection Regulation (“UK GDPR”), and other relevant statutory provisions.
2. Definitions
• “Consumer” – An individual purchasing eSIM Services for personal use.
• “Business Customer” – Any user acting for commercial, business or professional purposes.
• “eSIM” – Any digital SIM profile, data plan or service offered via Swansim.
• “Website” – The domain https://swansim.net including any affiliated subdomains.
• “Third-Party Payment Provider” – A PCI-DSS compliant external processor managing payment transactions.
• “User Content” – Any comments, reviews or materials submitted by Users on the
Website.
3. Scope of Terms
These Terms apply to all users of the Website, including both Consumers and Business Customers. Additional conditions may be published in relation to specific offers, promotional codes or voucher schemes. In case of conflict, such specific terms shall override these Terms. Use of personal data is subject to our Privacy Policy, which is deemed incorporated by reference.
4. User Eligibility & Commitments
You must be at least 18 years old or legally capable of entering into contracts in your jurisdiction. You agree to provide truthful and current information and to use the Services in a lawful manner.
5. Prohibited Conduct
The following activities are strictly forbidden:
• Payment fraud, identity theft or resale of eSIMs;
• Attempts to breach or bypass any system or network security;
• Transmission of spam, malware or abusive content;
• Intellectual property violations;
• Circumventing any service restrictions. Violations may lead to immediate suspension and legal remedies.
6. eSIM Use & Activation
You are responsible for ensuring device compatibility prior to purchase.
Connectivity and availability depend on third-party operators. Data limits and service validity are as advertised; unused portions do not roll over and are not refundable.
7. Payment & Pricing
Payments are securely processed via accredited third parties. Prices are shown in GBP and include applicable UK VAT unless stated otherwise. Buyers outside the UK may incur additional local taxes or charges.
8. Refund & Cancellation Policy
8.1 Statutory Cooling-Off Period (Consumers Only)
If you are a Consumer and have not yet installed or activated your eSIM, you are entitled to cancel your purchase within 14 calendar days from the date of transaction. This right is lost upon activation, installation, or profile scanning of the
eSIM. Business Customers are not eligible for this right.
8.2 Post-Activation Refund Exclusion
No refunds, credits or replacements will be provided once an eSIM has been downloaded, scanned, activated or otherwise used, except in the limited circumstances set out in Section 8.3 below.
8.3 Technical Failures Attributable to Swansim
In the event that the eSIM cannot be activated due to a verified fault caused solely by our systems or our upstream connectivity providers, you may be eligible for a one-time replacement or refund, subject to all of the following conditions:
• A refund request must be submitted to [email protected] within 48 hours of
purchase;
• You must provide complete evidence including your order ID, device screenshots, IMEI number, error logs, and time/date of attempted activation;
• Our technical support team must be able to reproduce and confirm that the fault lies entirely with Swansim or its partner;
• You must complete any troubleshooting steps we request.
If the issue cannot be resolved within 10 calendar days and is confirmed as our fault, we will, at our sole discretion, issue either a replacement of equivalent value or a full refund to the original payment method. Partial refunds are not available.
8.4 Non-Refundable Scenarios
Refunds will not be granted in the following cases:
• Activation on a device that is incompatible, locked, or restricted from roaming;
• Service interruption due to third-party carrier issues, latency, throttling, or congestion;
• Expiration of unused data or service validity;
• Orders placed more than 14 days prior to the request;
• Evidence of chargeback attempts, fraud, or breach of Terms;
• Claims relating to third-party losses (e.g. hotel Wi-Fi, VPN, roaming fees).
8.5 Fraud & Unauthorised Charges
Claims of unauthorised payment or fraud must be submitted within 7 days of the charge. We may request confirmation from your payment provider or a filed police report. If our investigation determines no compromise occurred, the claim will be denied.
8.6 Processing Fees
Any refund granted at our discretion that is not required under CCR 2013 is subject to an administrative processing fee of £10 or local equivalent.
8.7 Refund Procedure & Timeline
• Submit Request – Contact [email protected] with all supporting evidence.
• Initial Review – We aim to acknowledge requests within 2 business days.
• Final Decision – A determination will be made within 10 business days. This decision is final.
• Payment – Approved refunds are processed to the original method within 1–7 business days, depending on your card issuer.
8.8 Third-Party Resellers
If your purchase was made via a third-party platform or physical retailer, you must adhere to their refund terms. Swansim will not process refund requests on behalf of resellers or external marketplaces.
9. Promotional Offers & Vouchers
Promotional codes and gift vouchers are subject to specific expiry dates and conditions of use, as stated at the time of issuance. They are non-refundable, non- transferable, and may not be exchanged for cash unless required by law. Multiple
offers cannot be combined unless explicitly permitted.
10. Consumer vs Business Rights
10.1 Consumers: Individual users purchasing for personal use are entitled to the protections of UK consumer law. Where any part of these Terms conflicts with mandatory consumer protections, statutory rights shall prevail.
10.2 Business Customers: By using the Services on behalf of a company or for commercial purposes, you waive rights that do not apply to business-to-business relationships, including cooling-off periods under consumer law.
11. No Warranty Disclaimer
The Services and Website are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties—express or implied— including but not limited to merchantability, fitness for a particular purpose,
accuracy, or availability.
12. Limitation of Liability
12.1 Cap on Liability: Our total liability for any claim arising from your use of the Services shall not exceed the amount you paid for the specific eSIM or Service in question.
12.2 Excluded Damages: We shall not be liable for indirect, incidental, or consequential losses, including but not limited to loss of profits, data, business opportunities, or goodwill.
12.3 Mandatory Protections: Nothing in these Terms excludes liability for death or personal injury caused by negligence or for fraud.
13. User Content & Reviews
You may submit reviews, comments or other content (“User Content”) provided it is lawful, respectful, and non-infringing. By doing so, you grant us a non-exclusive, royalty-free, perpetual, and worldwide licence to use, display, and reproduce such content.
We reserve the right to moderate or remove User Content at our discretion.
14. Services Oversight
We reserve the right to monitor usage patterns, limit accounts, suspend data traffic, or take other actions to protect the network, enforce these Terms, or comply with applicable law.
15. Changes & Availability
We may update, revise, or discontinue parts of the Services or the Website at any time, with or without prior notice. While we aim to provide reasonable notice of significant changes, we are not liable for any resulting interruptions.
16. Suspension or Termination
We reserve the right to suspend or terminate your access to the Services immediately and without notice if we reasonably believe that you have breached these Terms, engaged in fraudulent or unlawful activity, or failed to make payment.
No refund shall be provided unless required by law.
17. Disputes & Legal Venue
17.1 Governing Law: These Terms shall be governed by and interpreted under the laws of England and Wales.
17.2 Jurisdiction: Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless you are a consumer in the EU and entitled to local court protections under Regulation (EU) No. 1215/2012.17.3 Alternative Dispute Resolution: Before initiating formal proceedings, you may use the UK’s Online Dispute Resolution platform (https://ec.europa.eu/odr) or another certified ADR entity.

These Terms operate in accordance with the following legal instruments:
• Consumer Rights Act 2015
• Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013
• Data Protection Act 2018 and UK GDPR
• Electronic Communications Act 2000

20. General Clauses
20.1 Updates: We may revise these Terms from time to time. Any changes take effect once published on our Website. Material updates will be notified via Website banner or email.
20.2 Severability: If any provision of these Terms is found unenforceable, the remainder will remain in full effect.
20.3 Entire Agreement: These Terms, together with referenced policies, constitute the entire agreement between you and the Company.
